Cloud on Title

Any claim, encumbrance, or apparent defect that casts doubt on the marketability of title and may require legal action to remove.

Clouds on title include open mortgages, expired liens still appearing in records, missing heir interests, gaps in the chain, and erroneous deeds. They impair the owner's ability to convey marketable title. Misconception: a cloud is not necessarily a current valid claim; it just creates doubt that needs resolution. Practically, FSBO sellers should run a title search before listing to identify clouds early. Quiet title actions resolve clouds when negotiation or curative deeds fail. In seller-financed transactions, clouds discovered late can derail closings or require contingent escrow holds until resolved. Title insurance covers most undiscovered clouds, but insurers often require curative action before issuing clean policies.
